Terms of Service
Effective September 30, 2026
The short version
- You must be 13 or older to have an account; under 18s need a parent’s permission.
- Clubs control their own information and must have permission for the people and details they add.
- You own what you post. Be respectful: Headcount is used by families and children.
- Headcount is free during the pilot, and it isn’t an emergency service.
- Massachusetts law applies.
1. Agreeing to these terms
These terms are an agreement between you and Route 128 Works (“we”, “us”), which runs Headcount at headcount.today and in the Headcount apps. By creating an account, accepting an invitation or using Headcount, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use Headcount.
If you use Headcount on behalf of a club or organization, you confirm you’re allowed to agree to these terms for it, and “you” includes that club.
2. Who can use Headcount, and your account
- You must be at least 13 years old to create an account. If you’re under 18, you need your parent or guardian’s permission.
- Give accurate information, and keep it up to date.
- Each account is for one person. Keep your password private, and don’t let anyone else sign in as you.
- You’re responsible for what happens under your account. Tell us at route128works@gmail.com straight away if you think someone else has used it.
3. Clubs, administrators and teams
A club’s administrators control its information in Headcount: its teams, schedules and rosters, who is invited, what access each person has, and who can see contact details. Administrators and coaches can add and remove people, send messages and reminders, and change or remove team information.
If you run a club or team in Headcount, you agree that:
- you have permission to add the people and information you add, including children’s information (for example with their parent or guardian’s consent) and people’s contact details;
- you’ll use people’s information only to run your club and teams;
- you’re responsible for your club’s activities, including its events, safety and supervision.
If you leave a team or club, or it removes you, the club’s records (such as past availability answers and messages) may stay with the club, as our Privacy Policy explains.
4. The service
Headcount is in an early, free pilot. We’re improving it all the time, so features may be added, changed or removed. We try to keep Headcount running and your information safe, but we can’t promise it will always be available, uninterrupted or free of mistakes. It may sometimes be unavailable for maintenance.
Headcount is a communication and organizing tool, not an emergency service. Always confirm important details, such as a changed time or a cancellation for weather, with your club or coach, and never rely on Headcount in an emergency.
5. Your content
“Your content” means what you put into Headcount: messages, availability answers and notes, photos, files, and similar. You keep ownership of it.
You give us permission to store, copy, display and send your content, only as needed to run Headcount for you, your teams and your club (for example, showing your message to the people you sent it to). This permission ends when your content is deleted from Headcount, except for copies kept as our Privacy Policy describes. We don’t use your content for advertising.
You’re responsible for your content. Only post what you have the right to share, and only post photos of other people when you have their permission, or their parent’s permission for a child.
6. Rules for using Headcount
Headcount is used by families and children, so please be respectful. Don’t:
- harass, bully, threaten or discriminate against anyone;
- post anything unlawful, hateful, violent or sexual. Any content that sexualizes a minor will be removed and reported to the authorities;
- share anyone’s personal information outside the purpose of running the team, or collect it for other purposes;
- pretend to be someone else or misrepresent your connection to a club, team or player;
- send spam or advertising, or upload viruses or other harmful code;
- try to get into accounts or information you don’t have permission to see, or get around Headcount’s security or access settings;
- copy information out of Headcount in bulk by automated means, or overload or disrupt the service;
- copy, change or reverse engineer Headcount’s software, except where the law allows it.
If you see something that worries you, especially anything involving a child, tell your club and email us at route128works@gmail.com.
7. Emails and notifications
By using Headcount you agree to receive emails and notifications about your account and your teams, such as invitations, password emails, event changes and reminders. You can manage many of them in Settings, as our Privacy Policy explains. Text messages are sent only if you turn them on for your own phone number; message and data rates may apply, and you can stop them at any time in Settings or by replying STOP.
8. Payments
Headcount is free during the pilot. If we introduce paid plans for clubs, or ways for families to pay club fees through Headcount, we’ll show the prices and the terms that apply before anyone is charged, and you’ll need to agree to them. Payments will be processed by our payment provider, Stripe, under its own terms. We’ll never charge you without your agreement. Our Refund Policy explains how cancelling and refunds work.
9. Headcount belongs to us
The Headcount name, logo, software and design belong to Route 128 Works. We give you a personal, non-transferable permission to use Headcount under these terms. You may not use our name or logo without our written permission.
If you send us ideas or feedback, we may use them to improve Headcount without owing you anything.
10. Copyright complaints
If you believe something in Headcount infringes your copyright, email route128works@gmail.com with: your contact details; the work you believe is infringed; where the material is in Headcount; a statement that you believe in good faith that the use isn’t authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for the owner; and your signature. We’ll review it and may remove the material.
11. Other services
Headcount links to or works with other services, such as maps for directions, calendar apps, app stores and our payment provider. Those services have their own terms and policies, and we aren’t responsible for them. If you use a Headcount app from an app store, that store’s terms also apply, and the store isn’t responsible for Headcount.
12. Suspending or ending use
You can stop using Headcount at any time, and ask us to delete your account at headcount.today/delete-account.
We may suspend or close an account, or remove content, if we reasonably believe someone has broken these terms, to protect other people or Headcount, or if the law requires it. Where it’s appropriate, we’ll tell you why. A club’s administrators can also remove people from their club.
13. Disclaimers
Headcount is provided “as is” and “as available”. As far as the law allows, we make no promises beyond those in these terms, including that Headcount will meet your needs, be available without interruption, or be free of errors. Information in Headcount, such as schedules, venues and rosters, is entered by clubs, coaches and families, and we don’t check it. We aren’t responsible for clubs’ or teams’ activities or events, or for what users post.
14. Limits on our liability
As far as the law allows, we won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of Headcount. Our total liability for any claim about Headcount is limited to the greater of the amount you paid us in the 12 months before the claim, or US $100.
You agree to cover our reasonable costs if a claim is brought against us because of your content or because you broke these terms, as far as the law allows.
Nothing in these terms limits any rights you have under consumer protection law that can’t be limited by agreement.
15. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, apart from its rules on conflicts of law. If you have a concern, please email us first at route128works@gmail.com so we can try to solve it together; if we can’t within 30 days, either of us may go to the state or federal courts located in Massachusetts, and we both agree to those courts’ jurisdiction.
16. Changes to these terms
We may update these terms as Headcount changes. We’ll update the date at the top, and if a change is significant, we’ll tell you in the app or by email before it takes effect. If you keep using Headcount after a change takes effect, you accept the new terms.
17. The rest of the legal fine print
These terms and our Privacy Policy are the whole agreement between you and us about Headcount. If a court finds part of these terms unenforceable, the rest still applies. If we don’t enforce a part straight away, we haven’t given up the right to. You may not transfer your rights under these terms; we may transfer ours as part of a merger, sale or reorganisation of our business. We may send you notices by email or in the app.
